Tenant Refuses to Vacate? Landlords, Avoid These Mistakes & Know Your Rights!
- •Do NOT cut utilities, change locks, or forcibly evict; these actions are illegal and can lead to criminal charges.
- •After agreement expiry, send a notice for vacation within 15-30 days, demanding compensation for overstaying.
- •Crucially, do NOT accept rent after the agreement expires; immediately refund any digital payments (UPI, bank transfer) to prevent a month-to-month tenancy under Section 106 of the Transfer of Property Act.
- •If the tenant still doesn't leave, file an eviction case in a civil court. Police usually don't intervene in civil disputes unless there's a threat, forceful occupation, or fraud (IPC sections apply).
- •Remaining silent, accepting rent without objection, or delaying action significantly weakens the landlord's legal position.
